The law

What the Skilled Immigration Act actually enables

The FEG (2020, expanded 2023) is not a free ticket – it is a structured framework with clear requirements. The most important thing: If you want to immigrate to Germany as a skilled worker, must fit into one of four columns.

01 The law

Four pillars – each with its own requirements

The four pillars of the FEG 2023

pillarFor whomSpecial feature
Specialists with professional qualifications State-recognized training (at least 2 years), recognized in Germany No minimum salary, but work must correspond to the degree
Skilled workers with university degrees Bachelor or higher, recognized in Germany or equivalent Basis for EU Blue Card with appropriate salary
Experienced specialists (from 2024) Min. 2 years of professional experience, qualification from a recognized state No formal recognition procedure necessary for certain countries
Opportunity card (from 2024) Qualified people without a job offer Points based: qualifications, age, German, professional experience
Pillars 3 and 4 are new and still in the implementation phase. Official practice and Processing times vary greatly depending on the embassy and country of origin. Always check the current status with the German embassy in your home country.

What has changed in 2023

The 2023 FEG amendment brought three significant innovations: Firstly, the Extension to professionally experienced specialists without formal German recognition (under certain conditions). Secondly, the introduction of the opportunity card as a points-based immigration system. Thirdly, that Acceleration of the recognition process through a new one Recognition partnership that makes it possible before the completion of the to enter the recognition process and to work under clear conditions.

For regulated professions, the license to practice the profession remains crucial. Nurses, doctors, engineers in certain fields and others Regulated professions are not automatically allowed to work fully in the target profession, as long as there is no recognition or professional license.

Professional recognition

When recognition is mandatory – and when it is not

Not everyone needs formal recognition. But who in one If you want to work in a regulated profession, you can't avoid it. Start the process before the job search begins – not after.

02 Recognition

Regulated vs. non-regulated – the crucial difference

Recognition procedure

Regulated professions: Recognition mandatory

Regulated professions in Germany are only allowed with an officially recognized one qualification can be exercised. The ban applies regardless of how many years experience someone has.

  • Doctors, dentists, veterinarians, pharmacists – Recognition by medical associations / licensing authorities
  • Nursing professionals – Recognition by regional councils or state authorities
  • Engineers (in regulated areas) – Chambers of engineers of the federal states
  • teachers, educators – Federal state ministries of culture
  • Lawyers, tax advisors – Professional chambers
  • Master craftsmen in trades requiring authorization – Chambers of Crafts

Non-regulated professions: Recognition voluntary

In non-regulated professions - the largest part of the labor market - can someone working without formal recognition. However, recognition improves it Application chances and can influence the salary. The skilled worker visa (Β§ 18a/b) requires recognition or a determination of equivalence still necessary to prove qualifications.

Recognition partnership: start earlier, but you are not allowed to do everything straight away

With the recognition partnership, a skilled worker can enter and work, while equivalence is still being established. The employer must actively support recognition and the workplace must support it Qualifications match. This does not mean that in regulated professions automatically full professional practice: independent activities remain until limited to professional licenses or recognition.

Recognition procedures take 1-6 months. For some authorities longer. If you wait until the job offer is available, you will lose months. Start the process as early as possible – parallel to the job search.

Target groups

Trucks, care and craftsmanship: what exactly matters

Three target groups often fail not because of will, but because of the wrong one Order. First clarify which recognition, driving license or language level is needed – then plan the contract, visa and appointment carefully.

03 Practice check

Not every skilled worker path works with the same documents

Check situation

Truck driver/professional driver

topic Check what? Why critical?
Special regulation Section 24a BeschV is relevant for professional drivers from third countries. The route depends on your driving license, qualifications and BA approval – not just on your employment contract.
Driving license Clarify third-country driving license, driving license conversion in EU/DE and proof of driver qualifications early. Without a suitable driving license, the person may not work as a truck or bus driver.
Salary No Blue Card minimum salary; However, working conditions must be comparable and legally permissible. From the age of 45, a minimum salary or proof of retirement provision may become relevant. A salary that is too low or unclear blocks BA approval and visa.

Nursing staff

topic Check what? Why critical?
Recognition Care is regulated: start the recognition process, deficit notice or professional license early. Without the appropriate notification, full activity as a nursing specialist cannot be planned clearly.
German B2 B2 is often required in practice; the responsible body decides which certificate is accepted. Language certificates are often the bottleneck between visa, recognition and actually starting work.
Recognition Partnership May allow start during procedure, but not automatic full nurse activity. Until you receive a license to practice your profession, only limited or supporting activities are often possible.

Crafts, technology and IHK professions

topic Check what? Why critical?
HWK or IHK? Classic crafts usually take place through the Chamber of Crafts. IHK FOSA is responsible for IHK reference professions. The wrong position costs weeks and leads to unnecessary questions.
Equivalence Training, content, practical evidence and duration are compared with the German reference job. Partial equivalence may require adjustment qualifications or evidence.
Visa For skilled worker visas, the qualification must be recognized, established or a permissible recognition route must be selected. Without reliable proof of qualifications, the application becomes unnecessarily risky.
Check these target groups not just by profession, but by order: Recognition, driving license or German first – then contract, visa and appointment.

Bottleneck occupations in 2025

Where the shortage of skilled workers is greatest

The Federal Employment Agency regularly publishes the so-called bottleneck analysis. The demand for qualified workers is particularly high in these professions – and the application opportunities for international skilled workers are correspondingly good. The EU Blue Card has a lower minimum salary for bottleneck occupations.

Immigration without a job offer – the points system

The Opportunity Card is the new points-based route to Germany – without a job offer, but with clear minimum requirements. Anyone who achieves the minimum number of points is allowed to enter the country to look for a job for one year.

04 Opportunity card

How the points system works

Basic requirement: qualification

Without a recognized qualification (professional qualification or university degree). the opportunity card is not accessible. The qualification itself does not give any points, but is the entry condition. Without them there is no application.

Points – how they are awarded

criterionPoints
German language skills A11 point
German language skills A22 points
German language skills B2+3 points
English language skills C1+1 point
Min. 2 years of professional experience in the last 5 years1 point
Professional qualification from a shortage occupation1 point
Age under 351 point
Connection to Germany (education, relatives, previous stays)1 point
Minimum points for the opportunity card: 6 points. You may not take up full-time employment during your stay (max. 1 year). Trial work (up to 20 hours/week) is permitted. After a job offer: Change to a residence permit for employment – without leaving the country.

Proof of Funding

Anyone who enters the country with the Opportunity Card must secure their own livelihood. The embassy requires proof - usually bank statements or a blocked account. Rule of thumb: provide proof of at least €1,000–1,200 per month.

Typical mistakes

What goes wrong with skilled worker immigration

01
Order

Looking for a job before the recognition process

The recognition process is only initiated once a job offer has been received - it takes up to 6 months. Correct: initiate the recognition process immediately, then apply at the same time. If you wait, you lose months in limbo between a job offer and a visa.

02
Visa choice

Wrong visa type for your own situation

Anyone who has a professional qualification and is applying for Section 18b (university qualification), or anyone who has a salary below the Blue Card threshold and is still applying for the Blue Card: The visa is rejected and the process has to start again. Before applying, identify your own situation carefully.

03
Regulation

Full professional practice without recognition

Even if a recognition partnership or an ongoing procedure is possible: In regulated professions, full independent work may only take place once recognition or a license to practice the profession has been granted. Anyone who is fully employed as a nurse, doctor or engineer in a regulated area without the appropriate permit risks legal proceedings, loss of job and problems with residence law.

04
Opportunity card

Working full time while looking for a job

The opportunity card does not allow full-time employment during the search period - only trial work for up to 20 hours per week. Anyone who still works full time loses their status and risks expulsion. After a job offer, apply for a change to your residence permit immediately.

05
Embassy

Appointment booked too late

In countries with high demand (India, Morocco, Vietnam, Pakistan), the waiting time for an embassy appointment is 8-20 weeks. Book the appointment before all documents are ready - the documents can be prepared while you wait.
